Sale agreed and one step closer to selling.
Having accepted an offer all parties will need to instruct a solicitor/conveyancer. We have access to a select network of specialists that understand the high level of service our clients expect and need in today’s fast paced and demanding property market. Likewise where mortgages are required (for you or your buyer) it is important to have done your research so that this vital part of the process does not delay matters. Our recommended mortgage advisers can help.
Top tip: Don’t compromise on the quality of your conveyancing/solicitor or mortgage expert.
The legal process
We know this can be confusing but don’t worry, we are here to help you through this process. You will receive advice and regular updates on how your sale is progressing. The solicitors will then write to all parties and the buyers may instruct a surveyor to conduct a survey of your property. If your buyer is requiring a mortgage, the lender will also instruct a mortgage valuation survey. Your solicitor will then draw up the draft contract, which sets out the terms of the sale and send to the buyer’s solicitors, together with all relevant documents. Any enquires will then be raised and local searches will be carried out. Once the draft contracts have been approved, they can be signed by both parties.
Top tip: Make sure your solicitor/conveyancer and buyer know your preferred completion dates from the outset.
Exchange of contracts
As long as the buyers mortgage offer has been received and cleared funds (non-refundable deposit) have been placed with the buyer’s solicitor, you will be ready to exchange contracts. Contracts can now be signed and exchanged at which point both parties are legally bound to complete the transaction. A mutual convenient completion date (move out date) can be agreed upon the exchange of contracts.
Top tip: Don’t leave it too late to book removals; nothing worst then having a completion date but no one to move you.
Time to open the champagne! Once your solicitor/conveyancer has received the money, your sale will be completed and the buyer will be able to move in.
Top tip: Before handing over the keys don’t forget to take meter readings, re-direct the post and leave any essential operating manuals or a written guide to help the new owners understand how everything works, they will appreciate the helpful gesture.
